This End User License Agreement ("Agreement") is a legal agreement between you ("you" or "End User") and phporyx ("phporyx" or "we") for the use of game servers hosted and rented by phporyx (the "Service"). By accessing or using the Service, you agree to be bound by the terms and conditions of this Agreement.

Subject to the terms and conditions of this Agreement, phporyx grants you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service solely for your own personal, non-commercial use. You agree not to use the Service for any other purpose or in any manner that violates any applicable laws or regulations.

You agree not to use the Service for any activities that are illegal, offensive, harmful, or otherwise inappropriate, including but not limited to:

a. Uploading or transmitting any content that is defamatory, abusive, obscene, vulgar, or otherwise offensive, including content that promotes or incites violence, discrimination, or hatred based on race, ethnicity, religion, or any other characteristic.

b. Using the Service for any criminal activity or to facilitate any criminal activity, including but not limited to hacking, phishing, fraud, or the distribution of malware, viruses, or other malicious software.

c. Uploading or transmitting any content that infringes or violates any intellectual property rights or other proprietary rights of phporyx or any third party.

d. Modifying or altering the server hostname to any inappropriate or offensive name, including but not limited to names that are derogatory or offensive in general, towards any individual or group, or towards any religious, nationalistic, or racial group, is strictly prohibited.

e. Using the Service to upload or distribute malicious files or to engage in any other activity that could harm the Service or any other user.

The Service and all related materials, including without limitation all software, graphics, text, images, logos, and other content, are the property of phporyx or its licensors and are protected by copyright, trademark, and other intellectual property laws. You acknowledge that phporyx retains all right, title, and interest in and to the Service and any modifications, enhancements, or updates thereto.

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY WARRANTY FOR INFORMATION, SERVICES, UNINTERRUPTED ACCESS, OR PRODUCTS PROVIDED THROUGH OR IN CONNECTION WITH THE SERVICE, INCLUDING WITHOUT LIMITATION THE SOFTWARE LICENSED TO YOU AND THE RESULTS OBTAINED THROUGH THE SERVICE. SPECIFICALLY, WE DISCLAIM ANY AND ALL WARRANTIES, INCLUDING WITHOUT LIMITATION: 1) ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, USEFULNESS, OR CONTENT OF INFORMATION, PRODUCTS OR SERVICES AND 2) ANY WARRANTIES OF TITLE, WARRANTY OF NON-INFRINGEMENT, WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION.

IN NO EVENT SHALL PHPORYX BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING, WITHOUT LIMITATION, PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES; LOSS OF USE, DATA, OR PROFITS; OR BUSINESS INTERRUPTION) HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, WHETHER IN CONTRACT, STRICT LIABILITY, OR TORT (INCLUDING NEGLIGENCE OR OTHERWISE) ARISING IN ANY WAY OUT OF THE USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE.

You agree to indemnify, defend, and hold phporyx and its affiliates, officers, directors, agents, and employees harmless from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to your use of the Service or any violation of this Agreement.

This Agreement shall remain in effect until terminated by either party. You may terminate this Agreement by discontinuing your use of the Service. phporyx may terminate this Agreement at any time for any reason or no reason, with or without notice to you. Upon termination, you agree to cease all use of the Service.
